These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Question Labs LLC ("Company," "we," "us"), the operator of the BOTCOIN Miner software and related services (the "Service"). The Service integrates with Bankr Bot ("Service Provider"), a third-party platform for wallet management, transaction execution, and LLM gateway access. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must not use the Service.
The Service is experimental software that automates participation in BOTCOIN mining challenges using large language models (LLMs). The Service interacts with blockchain smart contracts on the Base network (chain ID 8453) and third-party APIs. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, or uninterrupted availability.
You must be at least 18 years of age and have the legal capacity to enter into binding agreements in your jurisdiction. You are solely responsible for ensuring that your use of the Service complies with all applicable laws, regulations, and ordinances in your jurisdiction, including but not limited to securities laws, tax laws, money transmission laws, and cryptocurrency regulations. The Service is not available in jurisdictions where cryptocurrency trading, staking, or mining is prohibited.
You are solely responsible for maintaining the confidentiality and security of your Bankr API key, email credentials, and any other authentication credentials. You agree not to share your credentials with any third party. You are fully responsible for all activities that occur under your account, whether or not authorized by you. We are not liable for any loss or damage arising from unauthorized access to your account.
You expressly acknowledge and assume all risks associated with using the Service, including but not limited to:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUESTION LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, TOKENS, CRYPTOCURRENCY, OR OTHER INTANGIBLE LOSSES (EVEN IF QUESTION LABS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
QUESTION LABS LLC'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO QUESTION LABS LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00).
YOU ACKNOWLEDGE THAT THE SERVICE IS PROVIDED FREE OF CHARGE AND THAT THE LIMITATIONS OF LIABILITY SET FORTH HEREIN ARE A FUNDAMENTAL ELEMENT OF THE AGREEMENT BETWEEN YOU AND QUESTION LABS LLC.
Nothing in the Service constitutes financial, investment, tax, legal, or other professional advice. BOTCOIN tokens may have no value. Past mining performance is not indicative of future results. You should consult qualified professionals before making any financial decisions. We make no representations regarding the value, utility, or future prospects of BOTCOIN or any other cryptocurrency.
You agree to indemnify, defend, and hold harmless Question Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third party's rights.
We do not guarantee that the Service will be available at all times or without interruption. The Service may experience downtime, maintenance periods, bugs, errors, or complete unavailability without notice. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, temporarily or permanently, with or without notice, and without liability to you.
The Service integrates with Bankr Bot and other third-party services. Your use of these third-party services is governed by their respective terms of service and privacy policies. Question Labs LLC is not responsible for the availability, accuracy, security, or content of any third-party service. We do not endorse and are not responsible or liable for any third-party services.
The Service and its original content, features, and functionality are owned by Question Labs LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in such courts.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Question Labs LLC regarding the Service and supersede all prior agreements and understandings.
We reserve the right to modify these Terms at any time. Changes become effective upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.
